Legal basis

The legal basis for setting up the Buildings and Dwellings Register is the Buildings and Dwellings Register Act; the establishment of the Address Register is regulated in an Amendment of the Surveying Act. The parliamentary resolution for these two legal bases was passed on 29 January 2004 together with the E-Government Act since the Address Register, in particular, forms a key prerequisite for e-government. Both legal provisions came into force on 1 March 2004 (Federal Law Gazette I No. 9/2004) and lay down registration requirements for the municipalities as of 1 July 2004.

The Address Register Regulation governs the content and structure of the data in the Address Register and the reimbursement of costs for queries and extracts from the Address Register. It was promulgated on 20 July 2005 (Federal Law Gazette II No. 218/2005). An amendment to the Address Register Regulation was promulgated on 28 December 2007 (Federal Law Gazette II No. 395/2007).

The amendment of the Buildings and Dwellings Register Act came into force on 1 January 2010 (Federal Law Gazette I No. 125/2009)

  • The installation of a data collection of energy performance certificates
  • Adaption of definitions of terms
  • The inclusion of additional attributes
  • Usage rights for administration
